1 - Introduction
The company SPERNANZONI S.r.l., with registered office at Via Gentile da Fabriano, 66 - Italy, VAT number 01581820436, owns the trademarks that it markets and distributes through authorized retailers and via the website www.spernanzoni.com (hereinafter referred to as the "Website"), of which it is the owner.
These general terms and conditions of sale (hereinafter referred to as "General Terms") regulate the purchase of products from Spernanzoni S.r.l. (hereinafter referred to as "Products"), made remotely via electronic means through the Website. These purchases are reserved for Website users who intend to take advantage of the Product sales services (hereinafter referred to as "Customers").
The Customer is required to read and acknowledge these General Terms before completing a purchase on the Website. By placing an order, the Customer fully accepts these Terms as read, understood, and agreed upon.
The Customer must therefore comply with these General Terms, and Spernanzoni S.r.l. shall not be bound by any different conditions unless previously agreed upon in writing.
2 - Products
The Products available on the Website for online purchase include footwear and fashion accessories.
All Products are subject to availability. Spernanzoni S.r.l. reserves the right to change, at any time, the limits on the quantity and/or type of merchandise available for purchase on the Website. The Customer will be informed if their order cannot be fulfilled due to unavailability of the ordered Product.
3 - Prices
The prices of the Products are expressed on the Website in € (Euro) and include VAT. In countries where the transaction is not subject to VAT, the price will be displayed net of taxes. Delivery costs are excluded unless expressly indicated otherwise.
Spernanzoni S.r.l. constantly verifies that all prices indicated on the Website are correct, but cannot guarantee the absence of errors.
If a pricing error is found, Spernanzoni S.r.l. will offer the Customer the option to reconfirm the purchase at the correct price or cancel it.
4 - Promotions
Spernanzoni S.r.l. reserves the right to offer special sales conditions or promotions on Products available on its Website. The conditions applicable to promotions will be defined case by case through specific communications to Customers. Unless otherwise specified, these General Terms will apply.
5 - Registration
To complete a purchase on the Website, registration is required. The registration process involves filling out an electronic form with the Customer’s personal data and email address. These data will be processed in accordance with current privacy laws. Upon registration, the Customer will receive a personal account with a username and password.
The assigned credentials ensure anonymous identification of the Customer. It is the Customer's responsibility not to disclose their password to third parties under any circumstances.
The Customer is responsible for any actions and irregular conduct committed by anyone using their personal account in violation of applicable laws or these General Terms. The Customer must promptly report any theft, loss, or unauthorized use of their password or account to Spernanzoni S.r.l.
6 - Purchase Process
The essential characteristics and prices of the Products are specified in the individual Product offers on the Website.
To purchase Products, the Customer must complete and submit the online order form to Spernanzoni S.r.l., following the Website's instructions. The Customer must add the Product to their "shopping bag" and, after reviewing and accepting the delivery charges, General Terms, Privacy Policy, and return policy, select a preferred payment method and confirm the order.
Orders can only be placed after registration and account creation, as detailed in previous sections, by following the steps and instructions specified on the Website.
7 - Contract Formation
Displaying Products on the Website does not constitute a contractual offer by Spernanzoni but a mere invitation to make a purchase offer. The order submitted by the Customer, by clicking the "place order" button in the "Proceed to Purchase" section ("Order"), constitutes a purchase proposal.
Upon receipt of the Order, Spernanzoni will send an email confirmation to the Customer’s provided email address, acknowledging receipt of the Order and specifying its details (“Order Receipt Confirmation”). This confirmation does not constitute acceptance of the Order but serves to inform the Customer that Spernanzoni has received it.
The sales contract between the Customer and Spernanzoni is finalized only when Spernanzoni informs the Customer via email that the Order has been accepted and the Product has been shipped (“Shipping Confirmation”).
8 - Payment Methods
The Customer may pay for the Products and related delivery charges via credit card, PayPal, or bank transfer.
Spernanzoni S.r.l. accepts payments made by credit card.
To prevent online fraud, payments through the Website are processed by the relevant bank using MasterCard’s secure transaction tools.
MasterCard manages all financial information, including credit card number and expiration date, in a secure environment. Spernanzoni S.r.l. never accesses or stores credit card details.
The transaction will be charged to the Customer's credit card only after verifying the credit card details, receiving authorization from the issuing bank, and confirming the Product’s availability.
No charge is applied at the time of order submission.
Spernanzoni S.r.l. also accepts payments via PayPal.
9 - Shipping and Taxes
Spernanzoni S.r.l. ships using the DDP (Delivery Duty Paid) formula for EU countries, meaning that the merchandise will arrive at the specified location with no additional charges beyond those paid at checkout. For non-EU countries, the DDU (Delivery Duty Unpaid) formula applies, meaning that the courier may present an additional invoice for customs duties and taxes imposed by local authorities.
If the shipping address is within the European Union, VAT (22%) applies. If the shipping address is outside the EU, the merchandise is exempt from VAT under Art. 8, c.1, lett. a) - 21 - 23, D.P.R. No. 633/1972. Shipping costs, customs duties, and any clearance charges are borne by the Customer, including for returns.
10 - Shipping and Delivery
For the delivery of their purchases, the Customer may choose their residence, domicile, workplace, or the private address of a chosen individual. For security reasons, deliveries to P.O. boxes will not be made, and the order will not be processed.
For each order placed on the Website, Spernanzoni srl issues a receipt for the shipped goods, sending it to the order holder, in accordance with D.P.R. 445/2000 and D.Lgs. 52/2004. The receipt is issued based on the information provided by the Customer at the time of the order. No changes to the receipt will be possible after its issuance.
Delivery costs are borne by the Customer and are clearly indicated in the order form. They may vary depending on the chosen shipping method and the destination of the Products.
For the delivery of goods, the presence of the Customer or their representative is required at the recipient's address specified in the order. Upon delivery by the Courier, the Customer must check: (i) that the number of packages delivered corresponds to what is indicated in the transport document (DDT); (ii) that the packaging is intact, undamaged, and not wet or otherwise altered, including the sealing materials.
Any damage to the packaging and/or product or discrepancies in the number of packages or details must be immediately reported by placing a written reservation on the Courier’s delivery receipt. Once the document is signed, the Customer may not contest any external characteristics of the delivered goods.
If Spernanzoni srl is unable to deliver the ordered goods due to the unexpected unavailability, even temporary, of the Products, it will promptly notify the Customer, and in any case within 10 (ten) days, via email. The amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from the receipt of the purchase order.
11 - Shipping Number
Spernanzoni srl will send the Customer a confirmation email once the Products have been shipped.
To ensure the security of Product delivery, Spernanzoni srl will retain the shipping number of each completed delivery.
12 - Returns, Right of Withdrawal, and Order Cancellation
How can I return an item?
Fill out the return form and place it inside the box. The product must not be used, damaged, or washed. The return shipping cost is borne by the Customer. Send the package to the following address:

What is the valid return period?
The return period is 14 calendar days from the delivery date.
Do I have to pay for the return?
Yes, return shipping costs and customs duties, including for returns, are at your expense.
Do I have to pay customs duties for an order outside the European Community?
Shipping costs, customs duties, and any additional clearance charges are borne by the Customer, even for returns.
How will I receive my refund?
Once the return is approved, you will receive the refund via bank transfer to your bank account. You must provide your bank details, including IBAN and SWIFT, via email.
What is the right of withdrawal?
The "right of withdrawal" is established by Legislative Decree No. 185 of 22/05/1999, concerning distance contracts, as they are concluded outside commercial premises. Purchases on spernanzoni.com are subject to this regulation, allowing the consumer the right to withdraw from the contract. Under this right, the consumer may withdraw from the contract within 10 working days from the receipt of the goods.
Can I exercise the right of withdrawal and return an item that does not meet my needs?
If you have purchased an item and, despite matching the described technical characteristics, you find upon delivery that it does not meet your needs, you can exercise the RIGHT OF WITHDRAWAL. You may return the item to spernanzoni.com within 10 working days of receipt, and you will be refunded the purchase price. Contact Customer Service, which will authorize the return.
How long does the refund transfer take?
The seller must process the refund within 14 days of being informed of the buyer’s intention to withdraw from the contract, while retaining the right to withhold the refund until the goods have been received or documentary proof of shipment is provided by the buyer. Any refund will be calculated based on the consumer's liability in case of deterioration, use, and/or any cause not attributable to the seller. Within 30 working days of receiving the returned goods, spernanzoni.com will issue the corresponding credit to the customer based on the invoice value of the returned goods. Shipping costs are not included in the refund (in accordance with Article 5, Paragraph 6, Legislative Decree No. 185 of 22/05/1999).
Warning: spernanzoni.com reserves the right to refuse returns of components or products that:

Do not include original packaging, accessories, and manuals;

Were sent without activating the return request through Customer Service;

Were sent without following the shipping methods indicated by Customer Service.
In these cases, return shipping costs will be borne by the Customer.
When will I receive my refund?
Once the return is approved (items must be in perfect condition and with internal labels intact), you will receive an email confirming that the amount will be credited to your account within a few days. Please note that refund times depend on your bank.
What should I do if the refunded amount is incorrect?
Just contact our customer service, and we will resolve the issue as soon as possible.
spernanzoni.com reserves the right to refuse returns communicated or sent after the stipulated period or items that do not meet the original conditions.
13 - Liability for Defects
If the Customer believes that the Product does not comply with the Contract or has defects, they must promptly report it via email or fax.
The Product will only be returned if authorized by Spernanzoni.
Spernanzoni will examine the disputed Product and notify the Customer via email whether they are entitled to a refund or replacement. The refund will cover the purchase price paid by the Customer and any return shipping costs to Spernanzoni. The refund or replacement will be processed within 30 (thirty) days from receiving all banking details (including SWIFT code for foreign Customers) provided by the Customer.
Spernanzoni is not liable for Product defects caused by third-party delivery services.
Spernanzoni is not responsible for damages resulting from improper use, alteration, normal wear and tear, or negligence in caring for the Product.
14 - Errors and Inaccuracies
Spernanzoni srl aims to provide constantly updated information on the Website.
However, it is not possible to guarantee that the Website is entirely free of errors. The Website may contain typographical errors, mistakes, inaccuracies, or omissions, some of which may relate to Product prices, availability, and Product descriptions.
Spernanzoni srl reserves the right to correct errors, inaccuracies, or omissions even after an order has been placed and to change or update information at any time without prior notice.
15 - Authenticity Guarantee
Spernanzoni Srl guarantees the authenticity of all Products purchased on the Website. Spernanzoni products are entirely made in Italy with high-quality materials. All intellectual property rights, including trademarks, service marks, shape marks, and copyrights, are the exclusive property of Spernanzoni Srl. No page or content of this Website may be reproduced without prior express written authorization.
All content published on the website spernanzoni.com, including texts, documents, logos, images, graphics, videos, their arrangement, and adaptations, are subject to intellectual property laws and protected by copyright. It is not permitted to copy, alter, translate, distribute, use, store, or publish this content on other websites without prior written authorization from Spernanzoni. Spernanzoni Srl reserves the right to modify these General Terms and Conditions of sale at any time. Any changes, modifications, deletions, or additions will take effect immediately after they are communicated via notices published on the Website.
Once the notification has been made, any access to and use of Spernanzoni Srl’s services by the Customer will be considered as full acceptance of the changes.
JURISDICTION
This contract is deemed concluded in Italy and shall be governed by Italian law. For any disputes regarding the conclusion, validity, interpretation, or execution of this contract, if the customer is a consumer, the competent territorial jurisdiction is that of the court of the consumer’s place of residence or domicile, provided it is located within the State. In all other cases, the exclusive jurisdiction is that of the Court of Macerata.
PERSONAL DATA PROCESSING
Pursuant to Article 13 of Legislative Decree 196/2003, Spernanzoni Srl informs that personal, tax, and identification data acquired, including verbally, in relation to established commercial relationships—whether provided directly by the data subjects or acquired in any other way during the company’s activities—will be processed in compliance with the applicable regulations, including the confidentiality obligations provided therein.
EXPRESS TERMINATION CLAUSE
In the event of total or partial non-payment of the purchase price of the goods, Spernanzoni Srl reserves the right to declare this contract terminated pursuant to and for the purposes of Article 1456 of the Italian Civil Code, by sending written notification to the customer's email address.
